Background: 

Rule 3002.1

Effective 12/1/11, E-filers who represent mortgage creditors in Chapter 13's will need to file this event in response to the Trustee's Notice of Final Cure Amount and no claim has been filed.

Response

 

  • The form must be served on the debtor, debtor's counsel, and the trustee.
  • Please remember to use Form 4100R, when filing this event.

 

Reminder

Because no Proof of Claim was filed, this event will not appear on the Claims Register. After an e-filer has filed this event, it will only appear on the Bankruptcy docket.

 

 

 

 

 

Step by Step Instructions: 

  1. Access Bankruptcy >Creditor Claimant Activity

  2. Input Case Number

  3. Click Next

  4. Select Response to Notice of Final Cure Payment Rule 3002.1 (no Proof of Claim filed)

  5. Click Next

  6. The party screen will appear. Select or add the party you represent.

  7. Click Next

  8. The Attorney/Party Association screen may display.  If it does, click here.

  1. Click Next

  1. The following warning message will appear: 

    WARNING: This event should ONLY be used if a claim has NOT been filed.

    Click Next

  2. The following question will appear:

Has a Proof of Claim been filed?

Select the No Radio Button

  1. Click Next

    WARNING: Please continue to include the Certificate of Service as required by Bk Rule 3002.1.

    Please remember to use Form 4100R, when filing this event.

    This event should ONLY be used if a claim has NOT been filed.

  2. The PDF Document selection screen will display.

Attach your Document

  1. Click Next
  2. The Final Editing Screen will display.

    Verify the final docket text

  3. Click Next to submit the transaction and complete the filing process.
